A three-year legal battle over annexation ended yesterday when the = N.C.=20 Supreme Court upheld the city of Winston-Salem's plan to annex about 20 = square=20 miles of Forsyth County and more than 17,000 residents.

The annexation will take effect Sept. 30.

The high court decided to not review an appeal by county residents, = letting=20 stand an earlier decision by the N.C. Court of Appeals on the city's = plan to=20 annex several sections of land along the perimeters of the city.

Richard Browne, an attorney representing Forsyth Citizens Against = Forced=20 Annexation, said he was disappointed but not surprised.

"It was a victory in the sense that we saved three years of tax bills = for=20 people in the annexed areas," Browne said. "It's always worth it to = challenge=20 something you think is wrong. The (city- council members) will be very = careful=20 the next time they try to annex."

After the annexation, Winston-Salem will have more than 212,500 = residents and=20 overtake Durham as the state's fourth-largest city, according to 2004 = numbers=20 from the N.C. State Data Center and the city's 2004 annexation estimate = of=20 17,000 people.

Cities nationwide use annexation as a way to increase revenue.

In a city estimate done in 2004, officials said they expected to = collect $4.4=20 million in property-tax revenue in the first full year from the annexed = areas=20 and an additional $1.3 million in other revenues, such as business = licenses, and=20 gas and sales taxes.

But annexation will come with major first-year costs for the city and = delayed=20 tax bills for residents.

Because annexation will occur after the Sept. 1 deadline to send out=20 property-tax bills, the city will not be able to collect that revenue = until next=20 year's billing cycle. Without that money coming in, the city must foot = the cost=20 of services, including police, fire, roads, and garbage collection.

Budget Director Ann Jones said that the city plans to use about = $4million of=20 its $21 million rainy-day fund. The city expects to recover the money = when it=20 issues property-tax bills next year.

Property owners, meanwhile, will be billed for 21 months when the = September=20 2007 invoices are sent out. Residents in the annexed areas will get a = bill that=20 covers the period from October 2006 to June 2008, or nine months from = this=20 fiscal year and 12 months from the next fiscal year.

After the council's June 2003 vote on annexation, a group of county = residents=20 filed two lawsuits against the city based on concerns about the higher = property=20 taxes that would result.

Until Sept. 30, a homeowner in the areas to be annexed will pay = property=20 taxes only to Forsyth County. On a house valued at $200,000, a homeowner = pays=20 $1,320 a year in property taxes. After annexation, the same homeowner = will pay=20 taxes to the county and the city, and the tax bill on the $200,000 house = will=20 jump by $970, or 73 percent, to $2,290.

In return, residents who now pay for such services as garbage = collection,=20 water and sewer service and bulky-item pickup could see some = savings.

For example, county residents who pay about $200 a year for garbage=20 collection would no longer have that expense, officials said.

Greg Turner, an assistant city manager, said that the city is = prepared to=20 roll out services when annexation takes effect.

The city's Web site (www.city ofws.org) also has information on = annexation,=20 Turner said.

In the first lawsuit, which the state Supreme Court refused to review = in=20 October, the Forsyth Citizens Against Forced Annexation challenged North = Carolina's annexation law, saying that it was unconstitutional. County = residents=20 were not given equal protection because they were being annexed without = having=20 the power to vote on it, Browne said.

John Hopkins, a spokesman for the citizens group, has used the = public-comment=20 period during city-council meetings during the past year to say that he = is not=20 against annexation - he's against forced annexation.

In April, Forsyth County commissioners took a symbolic stand with = Hopkins,=20 approving a resolution asking the county's eight municipalities to annex = only=20 when people petition for it.

The second lawsuit, which the high court refused to review yesterday, = challenged the way that the city qualified the areas it sought as = eligible for=20 annexation. A certain percentage of land being annexed must have certain = characteristics - business, residential and vacant, for example. Browne = said=20 that the areas did not qualify on the basis of use or population.

Mayor Allen Joines said he is aware of the opposition to annexation, = but he=20 said he thinks that the new residents stand to benefit from city = services such=20 as new streetlights and garbage collection.

"I think in the long run - 10 or 15 years - instead of a having a = hodgepodge=20 (of services), I think it will be cheaper for everyone," Joines said. = "Taxes are=20 really not the reason we're doing this. It's all part of good urban=20 planning."
