The final meeting of the Joint
Commission ended with a bang.
The Commission passed recommendations for a moratorium 12 - 8 and
14 - 6
to give the affected
property owners a vote!
The "vote amendment" was called "the Goforth amendment" by the Commission Chair.
We need to thank and support
Representative Goforth for his firm stand on giving back to the people a vote on
municipal annexation

Beth Trahos
(BIO) is a member of the law firm's Land use and
Governmental Regulations Team. She represents developers, builders,
local governments, and advocacy groups in land use and municipal issues.
Beth regularly appears before City Councils, Planning Commissions, and
Boards of Adjustment in rezoning, site plans, special use permits,
subdivisions, annexations, text amendments and code interpretation. Ms.

McCarley was also recently appointed to the Governors panel which Easley

Professor Wegner is a long-time member of the Carolina Law faculty.
Wegner served as dean of the School of Law from 1989 to 1999, after
serving for eight years as a member of the faculty and for two years as
associate dean. She has taught and written in the areas of land use,
property law, state and local government law, and the rights of disabled
persons. She co-authored a book on race and poverty in American Cities.
Ms. Wegner has been appointed to Legislative Annexation Study Committees
in the past.

- Cities are using forced annexation for the wrong reason - to
take revenue rather than provide services.
- The power to annex is enabling fiscal irresponsibility by
the cities.
- Cities are abusing the law and treating taxpaying landowners
with disrespect.
- It violates American principles of government

COMMENTS
The Joint Commission met for the last time and
voted for recommendations for changes to the annexation
statutes.
Bills will be submitted to the General
Assembly in the next several weeks for consideration by the
House and Senate.
A moratorium and a recommendation to give the
affected property owners a vote passed a vote of the Commission.
Some other recommendations included changes to the required
services and higher densities to qualify.
If we get the vote, the other changes will be
hardly necessary.
Get ready to push hard on the
Legislators in 2009.
We know what we want and so do they. The Legislators have
studied this before many times.
It's time to act.
