The following is a letter sent to Rep. Morgan by a designated resident of Pinewild, and Morgan’s response:

Dear Mr. Morgan:

You are now aware that a formal association of Pinewild residents has been formed to aggressively resist annexation and we NEED your support. You are also aware that Pinewild residents were instrumental in your surviving the last primary challenge. In addition, you are aware that your associate recently lost an election to an individual who ran on an anti annexation platform.

The help which we seek is not unreasonable; to have the legislature act on the bills to defer annexation until a study can be conducted.

Should you not help us, your chances of winning the next primary are extremely slim. It would be unfortunate for your political career to end because of your unwillingness to help us.

As many of you know, I am in Italy working at the Winter Olympics. I believe, however, that it is important to send this update to all StTOP supporters, following the results of the vote on the Village’s annexation proposal.

 

Most important, thanks for your past support.  Our accomplishments rest squarely on your shoulders.

 

StTOP is encouraged by the results of the vote.  The numbers rejecting the proposal demonstrate strong support in Pinewild against forced, involuntary annexation.

 

We also had been advised by many of you that your vote to Accept was the choice between the lesser of two evils and/or to buy more time for our future efforts.  Clearly, the majority of Pinewild property owners remain opposed to forced, involuntary annexation.

 

Many have asked, “What’s next?”  We now have until 2008 to work toward changing forced annexation, both in the General Assembly and in the courts.  StopNCAnnexation, the statewide coalition against forced annexation, is putting together a lobbying effort and is aiding North Carolina communities that currently have annexation cases in the courts.

 

StTOP will continue to have a calm and measured approach to this task.  When I return in early March, the StTOP team will begin planning our next steps.  We will keep you informed, and we look forward to your continued participation and support.

Pinewild StTOP files amicus brief on behalf of Nolan Appeal to Supreme Court

represents more than 800 residents and property owners who have petitioned the Village of Pinehurst to cease annexation procedures.
 
StTOP
also represents 223 applicants supporting an amicus brief filed Tuesday, November 29, in the North Carolina Supreme Court, in support of the Nolans in the case Nolan v. Village of Marvin.
 
Our brief was prepared by Gene Boyce, one of the leading constitutional attorneys in North Carolina.  Attorney Boyce advised us that we indeed should file the amicus brief because of its similarities to the situation facing Pinewild.  We also have discussed with Attorney Boyce other trends in the North Carolina courts which strengthen StTOP's position.  
 
The Nolan case will be heard on December 13, and a decision rendered at a later date.  In essence, if the Court finds for the Nolans, municipalities may have a much more difficult time involuntarily annexing communities that already have their municipal services.  This ruling could quash the current annexation push by the Village, rendering moot any negotiations and/or agreements.
